These Terms & Conditions ("Terms") govern your access to and use of DeviceRent (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By accessing or using DeviceRent you confirm that you are at least the age of majority in your country, that you have the legal capacity to enter into this agreement, and that you accept these Terms in full. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

DeviceRent provides cloud-based device rental and remote access subscriptions. Users may book ephemeral device sessions, hold dedicated device slots, or purchase pooled credits, depending on their subscription tier. Specific features available to your account are determined by the plan you subscribe to.

The Service is provided over the public internet. Performance, latency, and availability depend in part on conditions outside DeviceRent's reasonable control.

3. Account Registration and Security

To use most features you must create an account. You agree to provide accurate information, keep it up to date, and safeguard your credentials. You are responsible for all activity that occurs under your account.

We strongly recommend enabling multi-factor authentication (MFA), which is available from the security settings page in your account. Some account actions may require an elevated authentication level. You must notify us promptly at info@devicerent.net of any unauthorized use or suspected compromise of your account.

4. Subscription Plans and Billing

DeviceRent offers several subscription tiers, including a free tier, recurring monthly plans with bundled credits, and a dedicated-slot tier. Tier names, prices, and bundled credits are listed on the pricing page and may change from time to time; changes will not affect billing periods already paid for.

Paid subscriptions are billed in advance through our payment processor (Stripe) at the price and billing interval shown at checkout. Subscriptions renew automatically at the end of each billing period unless cancelled. Mid-cycle upgrades and downgrades take effect according to the proration rules shown at the time of change. You authorize DeviceRent and Stripe to charge the payment method on file for all amounts due.

You are responsible for any taxes, duties, or similar government charges associated with your use of the Service, except for taxes based on DeviceRent's net income.

5. Free Tier and Trial Usage

The free tier is provided "as is" and may carry usage limits, feature restrictions, or session caps that differ from paid tiers. We may modify, restrict, or discontinue free-tier access at any time. Free-tier accounts are not entitled to a service level commitment.

6. Cancellation and Refunds

You may cancel your subscription at any time from your billing page. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.

Except where required by applicable law, fees already paid are non-refundable, including for partial billing periods or unused credits. If you believe you have been charged in error, contact info@devicerent.net within thirty (30) days of the charge and we will review your request in good faith.

7. Acceptable Use

You agree not to, and not to permit any third party to:

  • use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • upload, transmit, or generate any material that infringes the intellectual property, privacy, or other rights of any party;
  • introduce malware, ransomware, or any code intended to disrupt, damage, or surveil the Service or its users;
  • probe, scan, or test the vulnerability of the Service, or breach or circumvent any security or authentication measure;
  • reverse engineer, decompile, or attempt to extract the source code of the Service except to the extent expressly permitted by applicable law;
  • resell, sublicense, or share access to your account with third parties outside the scope permitted by your subscription;
  • use the Service to mine cryptocurrency, run unsolicited automated traffic, or otherwise consume resources in a manner inconsistent with normal interactive use.

We may suspend or terminate accounts that violate this policy, without refund and without prior notice where the conduct poses a risk to the Service or other users.

8. Device Sessions and Data

Device sessions are ephemeral by default: any data you place on a session device may be deleted when the session ends. You are responsible for backing up any work product or data you wish to retain. DeviceRent is not liable for loss of data resulting from the normal lifecycle of a session.

Dedicated device slots may persist data between sessions in accordance with the slot's documented behavior. Even on dedicated slots, you should not store sensitive personal data, regulated data, or anything for which an alternative storage medium would normally be used.

9. Intellectual Property

DeviceRent and its licensors retain all right, title, and interest in and to the Service, including all software, designs, trademarks, logos, and documentation. These Terms do not transfer any intellectual property rights to you, except for the limited right to use the Service in accordance with these Terms.

10. User Content and Responsibility

You retain ownership of any content you upload to or generate within the Service. You grant DeviceRent the limited, worldwide, royalty-free license needed to host, transmit, and display your content for the sole purpose of operating the Service.

You represent that you have all rights necessary to provide your content to the Service and that doing so does not violate any third party's rights or any applicable law.

11. Third-Party Services

The Service relies on certain third-party providers to function, including but not limited to Stripe (payment processing), Supabase (authentication and database hosting), Vercel (application hosting), Resend (transactional email), and Google Analytics (usage analytics). Your use of features that depend on these providers is also subject to their respective terms.

12. Service Availability and Modifications

DeviceRent makes commercially reasonable efforts to keep the Service available, but does not guarantee uninterrupted operation and does not commit to a specific uptime on the free tier. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, including for maintenance, security, or business reasons.

13. Limitation of Liability

To the maximum extent permitted by law, DeviceRent and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to your use of the Service.

DeviceRent's aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the total fees you paid to DeviceRent in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by law, DeviceRent disclaims all warranties, whether express, implied, or statutory, including any warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade.

15. Indemnification

You agree to indemnify and hold harmless DeviceRent and its affiliates from any claim, demand, loss, or expense, including reasonable legal fees, arising out of (a) your violation of these Terms, (b) your violation of any law or third-party right, or (c) your misuse of the Service.

16. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you breach these Terms, if your use poses a risk to the Service or other users, or if required by law. On termination, the sections of these Terms that by their nature should survive termination will continue to apply.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will give you reasonable notice before they take effect, for example by sending an email to the address associated with your account or by posting an in-app notice. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.

18. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which DeviceRent operates, without regard to its conflict-of-law rules. The parties agree to attempt in good faith to resolve any dispute informally before commencing formal proceedings. Where informal resolution fails, the parties may submit the dispute to binding arbitration or to the courts of competent jurisdiction in the location where DeviceRent is established.

Nothing in this section limits any non-waivable consumer right you may have under the mandatory law of your country of residence.

19. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect and process personal data, and our Cookie Policy.
